2. General terms and conditions for using the Site and proposed services

Use of the Site implies the full and unreserved acceptance of the General Terms and Conditions detailed below. These General Terms and Conditions are subject to modification at any time without notice. Users of the Site are therefore welcome to review these General Terms and Conditions on a regular basis.

This Site is intended to be accessible to Users at all times. Service interruption for technical maintenance may nonetheless be undertaken by SIFA. We will take all reasonable measures to communicate expected intervention dates and times to Users beforehand.

The Site is updated regularly by Thomas Perier. Similarly, legal mentions on the Site may be modified at any time and without prior notification. It is the User’s responsibility to refer to those legal mentions as often as necessary to remain aware of their most recent content.

3. Description of provided services

The purpose of the Site is to provide information regarding SIFA’s overall activities.

SIFA makes every effort to ensure that the information provided on the Site is as accurate as possible. Nonetheless, SIFA shall not be held liable for omissions, incorrect information, or incompleteness with respect to content and/or updates, whether due to action by SIFA or its third-party partners providing information for the Site.

All the information provided on the Site is non-contractual and presented to users for information purposes only. That information is subject to modification without notice. Furthermore, the information provided on the Site shall not be considered as being exhaustive. Information is presented with the reservation that changes may have been made to said information since it was published on the Site.

4. Contractual limitations for technical data

The Site uses JavaScript technology.

SIFA shall not, under any circumstances, be held liable for any property damage related to the use of the Site. Furthermore, Site users agree to access the Site using up-to-date computer equipment that is virus-free, and with an up-to-date recent-generation Web browser application.

5. Intellectual property and counterfeit

SIFA owns the intellectual property rights, or holds the rights to use, all the elements accessible on the Site, notably text, images, graphics, logos, icons, audio, and software.

It is strictly forbidden to reproduce, represent, modify, publish, or adapt any or all the elements on the Site, regardless of the means or process used, without prior written consent from: SIFA.

Any unauthorized use of the Site or any of its contents shall be deemed as an act of counterfeit under the provisions of Article L. 335-2 and following of French Intellectual Property Code.

6. Liability limitations

SIFA shall not be held liable in any manner whatsoever for any direct or indirect damage caused to the Site User’s property or equipment while accessing the Site, notably resulting either from using equipment incompatible with the specifications indicated in Section 4 above, or due to a bug or any other type of incompatibility.

SIFA shall not be held liable for any indirect damage, such as, but not limited to, the loss of business or business opportunity following the use of the Site.

Interactive spaces are offered to Site users, notably for submitting questions using the Contact form. SIFA reserves the right to delete, without prior notification, any content submitted via said spaces that violates applicable legislation in France, in particular with respect to data privacy. SIFA reserves the right to pursue the User’s civil and or criminal liability as appropriate, notably in cases of submitting messages with racist, abusive, defamatory, or pornographic content, regardless of the media used, such as text, photographs, or any other form.

7. Personal data management

Personal data is protected in France by Law no. 78-87 of January 6, 1978, Law no. 2004-801 of August 6, 2004, Article L. 226-13 of the French Criminal Code, and the European Directive of October 24, 1995.

The following information may be collected when using the Site: URLs of links visited by the user on the Site, the name of the user’s Internet access provider, and the user’s Internet Protocol (IP) address.

SIFA only collects personal information about Users for needs related to providing certain services on the Site. In those cases, the User is fully aware of providing said personal information, notably when that User enters the information directly. It is stipulated in the context of entering information whether Users of the Site are required to provide personal information.

In compliance with provisions of Articles 38 and following of French Law 78-17 of January 6, 1978, as amended, on Data Processing, Data Files, and Individual Liberties, all Users have the right to access, rectify, and oppose the use of their personal data. To exercise this right, the User must submit a written and signed request, along with a copy of the User’s identification document that is also signed, and clearly indicate the address to which a response should be sent.

No information about any User of the Site is ever published in any form whatsoever without the User’s explicit consent, nor is any such information ever exchanged, transferred, assigned, or sold via any type of media to any third-party whatsoever. Only in the event of the acquisition of SIFA and its rights and obligations by another entity would transmission of said information be allowed to the potential acquiring party, which would then be wholly obliged to respect the same conditions for handling, storing, and modifying personal data pertaining to Users of the Site.

The Site is not declared with the French data protection authority (CNIL), as it does not collect personal information. .

Databases are protected by provisions of the French Law of July 1, 1998 implementing European Directive 96/9 of March 11, 1996 relating to the legal protection of databases.

8. Hypertext links and cookies

The Site contains hypertext links with references to other websites. SIFA is authorized to implement said links. However, it is not possible for SIFA to verify the content of Sites referenced by hyperlinks, and, as such, SIFA shall not in any manner be held liable for content on other websites.

Cookies may be installed on the User’s computer when navigating on the Site. A cookie is a small text file that stores information regarding a computer’s navigation on a given Site. Cookies do not store information enabling the identification of the User. Data obtained from cookies is used to facilitate subsequent navigation on the Site, as well as to enable measuring the User’s frequency of Site use.

Refusing to allow the installation of cookies may prevent the User’s access to certain services. Users may nonetheless configure their computer as described below to block the installation of cookies (the instructions below are intended to provide guidance and may not apply exactly as described to all versions of the indicated browser applications):

For Internet Explorer: Tools tab (gear-shaped icon in the upper right-hand corner) / Internet options. Click on Privacy and select “Block all cookies”. Click on OK.

For Firefox: Click on the menu button in the top right-hand corner of the browser screen and select Content Blocking. This opens the Privacy & Security panel of Firefox Options.

Configure your settings for Content Blocking, which includes cookies. Select the desired option for cookies.

For Safari: Click on the menu icon in the upper right-hand corner (gear icon). Select Settings. Select “Show advanced settings”. In “Privacy”, select Content settings. You may choose to block cookies in the cookies section.

For Chrome: Click on the menu icon in the upper right-hand corner (three horizontal lines). Select Settings. Select “Show advanced settings”. In “Privacy”, select Preferences. You may choose to block cookies in the Privacy section.

9. Applicable law and jurisdiction

All disputes related to the use of the Site are subject to French law. Exclusive jurisdiction is granted to the competent courts of Paris, France.
